Terms of Use

1. Who we are

CookCredit LLC builds practical technology for food skills, restaurant service, and physical interaction. Our products include CookCredit Skill and Toque. References to "CookCredit," "we," "us," and "our" mean CookCredit LLC.

2. Accepting these Terms

By using a CookCredit service, you agree to these Terms and the policies linked from them. If you use a service for a restaurant, school, employer, or other organization, you represent that you are authorized to act for that organization. If you do not agree, do not use the service.

3. Accounts and eligibility

You must provide accurate information, protect your credentials, and promptly report suspected unauthorized access. Some camera-based or biometric experiences may be limited to adults and may require a separate affirmative consent. The age and consent requirements shown in that product control.

4. CookCredit Skill

CookCredit Skill analyzes a work sample and produces measurements or feedback about a captured session. Scores and observations are informational and reflect the recording, camera position, lighting, device, and model version used at that time. They are not a food-safety license, employment guarantee, professional certification, or promise of future performance.

Knife work and kitchen activity involve real risk. Use a stable surface, suitable tools, safe technique, and appropriate supervision. Stop if the environment is unsafe. CookCredit does not supervise your physical environment and is not a substitute for hands-on safety instruction.

5. Toque

Toque lets an authorized creator connect an NFC tag, QR code, RFID identity, or similar touchpoint to a server-managed action. Creators are responsible for the destinations, instructions, content, permissions, and integrations they configure. People should be told what a touchpoint will do before an action with meaningful consequences is completed.

6. Restaurants, teams, and human decisions

CookCredit products can reduce steps and make information easier to reach, but they do not replace a restaurant's safety procedures, employment decisions, training obligations, accessibility duties, or professional judgment. A person or organization remains responsible for decisions made using product output.

7. Acceptable use

You may not break the law; harm, threaten, or impersonate another person; submit content without the necessary rights or consent; manipulate an assessment; bypass security or access controls; probe or overload our systems; use a touchpoint deceptively; or use our services to build a competing dataset or model without written permission.

8. Your content

You keep ownership of content you submit. You give CookCredit a limited license to host, process, reproduce, and transmit that content only as needed to provide, secure, maintain, and improve the service, subject to the Privacy Policy and any product-specific consent. You represent that you have the rights and permissions needed to submit it.

9. CookCredit property

Our software, designs, documentation, models, trademarks, and original content are owned by CookCredit or its licensors. We give you a limited, revocable, non-transferable right to use the services for their intended purpose. No other rights are granted.

10. Third-party services

Our services may link to or work with third parties. Their terms and privacy practices govern their services. CookCredit is not responsible for a third-party service, product, price, availability, or decision.

11. Service changes

Products may change as we learn from real use. We may add, remove, suspend, or discontinue features, correct scores or records, limit access, or take action to protect people and systems. We will provide notice when reasonably practical if a change materially affects an active paid service.

12. Disclaimers

To the extent permitted by law, the services are provided "as is" and "as available." We do not promise that they will always be uninterrupted, error-free, secure, or suitable for every purpose. Nothing in these Terms excludes a warranty or consumer right that cannot legally be excluded.

13. Limitation of liability

To the extent permitted by law, CookCredit and its officers, employees, and affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, or goodwill. Our total liability for a claim relating to a service will not exceed the greater of USD $100 or the amount you paid CookCredit for that service during the 12 months before the event giving rise to the claim. Some jurisdictions do not allow every limitation, so parts of this section may not apply to you.

14. Termination

You may stop using the services at any time. We may suspend or terminate access when reasonably necessary for security, legal compliance, nonpayment, material misuse, or a violation of these Terms. Provisions that by their nature should survive will remain in effect.

15. Governing law

These Terms are governed by the laws of the State of Georgia and applicable United States federal law, without regard to conflict-of-law principles. Nothing here prevents either party from using a court with proper jurisdiction or a lawful small-claims process.

16. Changes and contact

We may update these Terms. We will change the effective date and provide additional notice when a change materially affects an active service. Questions can be sent to connectwithus@cookcredit.com.
